        Well yesterday there was delivered to me the same aftermarket SS spoiler I already have that was also damaged in shipping. I guess this just isn't meant to be.

          Go after the shipping company to replace it with the cost of an OEM one

              Man that friggin sucks! I'm sure you will find something. And when you do and Nate isn't up for your spoiler let me know.

                damn that sucks so the seller advertised a OEM spoiler and it wasnt even OEM and it was damaged? Dude get busy on getting that $$ back!

                    you need to file a complaint with them claiming that your product was delivered damaged. They will take it from there, they will ask you for proof of the transaction and etc.

                      I have everything filled out but when i enter the tracking number it automatically enters a fedex/kinkos store information as the sender. Should I let it use that info or use the guy that i bought it from instead?

                          I think that if anything arrives damaged it is the responsibility of the sender to file the complaint. The money is actually going to go back to him from what I understand. That may be why it is going to a fedex/kinkos store. You should contact the seller and let him know that it arrived f'd up and take it from there.

                            yes, good advice right there. I would do both, contact the seller and fedex.

                              I already did contact the seller, have not heard from him yet but he was not fast to respond with me in the first place.

                              Is this going to require me to ship the spoiler back?

                                Just because Joel got a great deal on an OEM spolier, doesn't mean that its that easy to find another OEM one for that price. Start throwing around "replacement value" if you talk to the shipper Joel.

                                If this is the truth I would be livid. At the point that the seller relaeses it to the shipper, things are out of his hands. If it arrived damaged, why does that effect the seller? It doesn't, the buyer is the one with the issue, therefore would file the claim and recieve any replacement money. Not saying you are wrong, just saying the above scenario is the only logical one imo
